Terms of Service

These Terms of Service set the rules for using Moiloo Wifi, including account responsibilities, acceptable use, billing, data handling, and service limitations.

1. Acceptance of these terms

By creating an account, accessing, or using Moiloo Wifi (the "Service"), you agree to these Terms of Service. If you are using the Service for an organization, you represent that you have authority to accept these terms on its behalf.

2. The service

Moiloo Wifi provides tools for hospitality venues to deploy branded WiFi captive portals, collect guest information, display promotions, manage access, and view analytics. Features may vary by plan and may change as we improve the Service.

3. Accounts and security

  • Provide accurate, current information and keep it updated.
  • Keep login credentials confidential and use reasonable safeguards to protect your account.
  • Promptly notify us if you suspect unauthorized access or a security incident.
  • Accept responsibility for activity under your account, except to the extent caused by our failure to use reasonable security measures.
  • Ensure that account users are authorized to access the Service and follow these terms.

4. Acceptable use

You may not use the Service to:

  • Collect personal information without an appropriate notice, legal basis, or consent where required.
  • Break the law, infringe another person's rights, or facilitate fraud, harassment, or abuse.
  • Upload malware, harmful code, or content that interferes with the Service or another user's network.
  • Probe, scan, reverse-engineer, circumvent security controls, or attempt unauthorized access.
  • Resell, sublicense, or share access to the Service outside the permissions of your plan or written agreement.
  • Use the Service to send unsolicited communications or misrepresent your identity or affiliation.

5. Venue operator responsibilities

If you use Moiloo Wifi to collect guest information, you are responsible for your portal content, collection practices, guest notices, consent language, marketing permissions, retention settings, and compliance with applicable privacy, consumer protection, telecommunications, and marketing laws.

You must provide guests with a clear way to understand how their information will be used and must respond to guest requests when you are the data controller. Our GDPR page describes how we support venue operators as a service provider.

6. Plans, billing, and trials

Plan prices, usage limits, trial terms, and billing frequency are shown at signup or in your order form. Paid subscriptions renew for the selected billing period unless canceled before renewal. You authorize us or our payment provider to charge the payment method on file for applicable fees and taxes.

Unless required by law or stated in an order form, fees are non-refundable and partial billing periods are not prorated. We may change prices with reasonable advance notice; changes apply at the next renewal unless otherwise stated.

7. Ownership and permitted use

Moiloo Wifi and its software, designs, documentation, and branding are owned by Moiloo or its licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription.

You retain ownership of content, branding, and guest information that you submit. You grant us the limited rights needed to host, process, transmit, and display that content to provide the Service.

8. Confidentiality

Each party will use reasonable care to protect non-public information received from the other party and use it only to perform or receive the Service. These obligations do not apply to information that is public, independently developed, lawfully received from another source, or required to be disclosed by law.

9. Availability and third-party services

We work to keep the Service available and will communicate planned maintenance when reasonably possible. We do not guarantee uninterrupted or error-free operation. The Service may depend on internet access, network equipment, payment providers, email providers, and other third-party services that we do not control.

10. Disclaimers and limitation of liability

To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties other than those expressly stated in an order form. We do not warrant that the Service will meet every business requirement or that every guest will be able to connect.

To the maximum extent permitted by law, Moiloo Wifi will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or goodwill. Our aggregate liability for claims relating to the Service will not exceed the fees you paid or owe for the Service during the twelve months before the event giving rise to the claim.

11. Suspension and termination

You may stop using the Service or cancel your subscription according to your plan or order form. We may suspend or terminate access if you materially breach these terms, create a security or legal risk, fail to pay applicable fees, or if we discontinue the Service. We will provide reasonable notice when practical.

After termination, we may retain information for a limited period to support export, resolve disputes, meet legal obligations, and complete ordinary backup deletion cycles.

12. Changes and contact

We may update these terms from time to time. Material changes will be posted here or communicated through the Service. By continuing to use the Service after the effective date, you accept the updated terms.
